I am part of the academic staff in the Chair of Practical Philosophy, Philosophy of Law and Social Philosophy at the Humboldt University of Berlin. At the same time, I am a member of the GRK 2638 Normativity – Critique – Change at the Free University in Berlin, where I am currently working on my dissertation under the supervision of Rahel Jaeggi and Christoph Möllers. I hold a M.A. in Philosophy from the Pontifical Catholic University of Peru, where I am a member of the Grupo de Investigación sobre Teoría Crítica and Grupo de Investigación sobre la Actualidad del Pensamiento de Hegel. I am also a member of the Red Iberoamericana Foucault.

Law and Social Change: Towards an Immanent Critique of a Contradictory Interrelation

Based on empirical observations, a relationship of tension between law and social change can be outlined, since on the one hand the former realizes the latter through specific laws and rights, but on the other systematically blocks it. Insofar as this is not merely an instrumental liaison, which might be accordingly reduced to a question concerning the institutional design of legal systems, the dissertation strives rather for a theoretical understanding of a fundamental ambivalence: why is it that law realizes and blocks social change at the same time? In other words, how can this contradictory interrelation be conceptualized? To adequately address such a problem, the interaction between normativity and materiality in modern law needs to be examined. My thesis is that this interaction in law turns out to be reflexive and ideological at the same time. For the sake of its own legitimacy, modern law must be capable of reflexive change and criticism. However, in view of the structural demands for legal security within capitalist societies, modern law has to guarantee an effectively stable and integrated cohabitation. Because a functional legal order must therefore materially undermine its own normative promise of reflexivity, it simultaneously turns out to be ideological. Three forms of legal critique thus emerge from a reconstruction of that practical contradiction in modern law: an external, an internal, and an immanent legal critique. Finally, the research project is to be understood as the outline of an immanent critique of the contradictory interrelation between law and social change, which shall bring to light both the systematic crises as well as the emancipatory potential in modern law.
